On July 3,
2007, United States Senator Charles Schumer held a
press conference at the historic home of one of our
own SayNo2NYRI members to announce new legislation
he's going to introduce to fight both the worst
features of the Energy Policy Act of 2005, as well
as to help stop the NYRI plan.
Members of
SayNo2NYRI’s Board of Directors in attendance were

Senator Schumer’s
bill contains three major elements: 1) It would
remove the right of an applicant under EPACT to use
eminent domain to seize people’s properties; 2) It
would clarify EPACT to provide that the state siting
authority (in this case, the Public Service
Commission) has the right to deny an application
without such a denial automatically conferring FERC
jurisdiction on the project; 3) It would require a
transmission project applicant to prove that a PSC
denial was without merit in order to be permitted to
go to FERC for further consideration. |
